1.8 Conditions package option ‘International’

Definition of services: The use of telephone numbers, call channels and other communication services abroad

  • TCF has the right to cancel any services used under the international option at any time with one month’s notice in writing. Reasons for this may be regulatory changes (new laws, requirements, etc.), major financial shifts or surcharges for international access/offers, as well as technical limitations or technical incompatibilities
  • Customers undertake to use the services within the scope of their normal business activities and, to the best of their knowledge and belief, to comply with the regulatory requirements of the respective supervisory authorities and regulators in the relevant countries.
  • The customer undertakes to use the services in accordance with the relevant local and international legislation. Abuse, fraud or other illegal activities carried out with the help of these services will lead to the immediate cancellation of the services if they become known. This also applies to violations of requirements for sanctioned areas/countries that are on the EU/US or UN sanctions list or on the US embargo list.
  • Customers undertake to keep a list of the names of end users (address and contact details) for all subscribers who use the services as part of their business activities and to hand this over within 24 hours if requested by the authorities
  • If a number is cancelled or ported by a customer, a fee or administration charge may be payable depending on the country/destination. The amount depends on the country and the number of cancelled or ported services
  • DID (numbers) must be used for 3 months after commissioning and can then be cancelled with 1 month’s notice to the end of a month. If a number is cancelled in advance, a fee of CHF 15 per month/number will be charged
  • Force Majeure: All parties shall be held harmless in the event of events that are generally known as force majeure and have an influence on the fulfilment of the contract. Force majeure shall include all circumstances beyond the control and influence of the contracting parties, such as natural disasters, government measures, official decisions, blockades, war and other military conflicts, mobilisation, civil unrest, terrorist attacks, strikes, lockouts and other labour unrest, confiscation, embargoes, epidemics, pandemics or other circumstances which are unforeseeable, serious and beyond the control of the contracting parties and which occur after the conclusion of this contract.
  • If one of the contracting parties is prevented from fulfilling its contractual obligations due to force majeure, this shall not be deemed a breach of contract and the deadlines specified in the contract or on the basis of the contract shall be extended appropriately in accordance with the duration of the impediment.
  • The same shall apply if TCF is dependent on the advance performance of third parties and this is delayed due to force majeure. Each party shall do everything in its power that is necessary and reasonable to minimise the extent of the consequences caused by the force majeure.
  • If a force majeure event lasts longer than 30 days, either party may terminate this agreement without any liability or costs if the respective party cannot reasonably be expected to adhere to the contract. However, any costs already incurred or services already provided must be paid by the party placing the order.
  • The maximum call duration is 3 hours, after which the line is disconnected for security reasons. This serves as a security measure to make cases of fraud with foreign destinations more difficult
  • Access to so-called ‘blue light’ services (emergency services) is generally possible for national services worldwide, but is not guaranteed – TCF is not liable for incidents resulting from any unavailability of such services. In addition, the customer accepts and confirms that in the case of nomadic telephony, the location of the caller cannot always be automatically determined correctly by the emergency services. This means that the customer informs and instructs his employees in this regard and ensures that the employees can alert emergency services via other means of communication
  • Unusual use: If TCF establishes that the services are being used in an unusual manner (call centre, machine and automated dialling or other abusive use), TCF has the right to terminate the service at any time with immediate effect
  • Quality of service: TCF relies on well-known and reliable partners for national and international IP telephony, but cannot guarantee the quality of the services used; the quality is influenced by many factors (Internet, end devices, public networks, etc.) which are beyond TCF’s control.
